Privacy Policy

In this privacy policy, “we” and “our” relates to Sellerdeck Limited company number 03221222 which is a company registered in England and Wales.

“You” and “your” relates to the natural person reading this document that is authorised by their business and that is considering subscribing or subscribes to the Sellerdeck Services or is an employee or subcontractor of such a business.

“Sellerdeck Services” refers to the services we provide to help you or your colleagues run your business and includes but is not restricted to: support, hosting, online customer feedback, shipping and delivery services and payment processing.

“Sellerdeck Software” refers to the software we provide to help you or your colleagues run your business and includes but is not restricted to: an online ecommerce platform and a desktop ecommerce platform.

Why we are processing your data

The main purpose of processing your data is to enable us to provide our services to companies that wish to sell goods and services online and by mail order and telephone order.

We will also process your data to inform you of: the status of the Sellerdeck Services, changes in the Sellerdeck Software, relevant changes in the market that relate to selling online and future developments of the Sellerdeck Services and Sellerdeck Software.

We want to ensure that you are kept up to date with improvements that will benefit you and your business and so will process your data to inform you of how to use our products and services, including updating you on new features and services.

What data do we hold?

We hold the data that you (or someone from your company) inputs or confirms either at our web site, into the Sellerdeck Software that you have licensed from us or over the phone. This data is limited to the information described here.

The data we hold consists of your name, address, email, phone number, and other means of contacting you that you supply to us, for instance your address for calling, emailing or messaging. We also hold data that is generated when you input or raise any support queries, for instance by sending an email or typing into a chat facility. During conversations with you, we will record information you provide to us to help us deliver the best possible service, this typically is related to your business and its objectives but may contain personal data if you supply it.

For each device where you use the Sellerdeck Software we hold your IP address (Internet address), model, operating system and version of the device so that we can solve problems when they occur which require this information. We also hold this information in order to check and enforce our license conditions.

Our terms and conditions do not permit you to enter into the Sellerdeck Services or Sellerdeck Software any personal information relating to race, religion, political affiliation, trade union membership, sexual orientation, medical or genetic history and the Sellerdeck Services and Sellerdeck Software does not store any information of this nature.

How we service your needs

We provide most of our services to you on the legal basis of Contract as your processor. These are the terms and conditions that you agree to when you subscribe to one or more of our services by registering your details with us or license our software. We inform you of the status of any free trials of our products or services, we process all of the requests that you make of our services as well as informing you how to use the software and services and any additional features that have been released. We always offer you the opportunity to opt out of communication which is not essential to the running and billing of the services at any time that you want to.

Processing data about your contract with us

We also hold data about our commercial relationship with you, that is invoices and payment details, on the basis of Legal Obligation where we have to hold this information for tax and statutory authorities.

Co-operating with legal authorities

We will pass information about you and your business to legal authorities who have the legal right to demand such data.

How we market

Our third party partners will only ever send you relevant communication, if you have an active service with them. Without prior Consent, we will never share your personal details with any third party that you do not subscribe to.

Our staff may contact you to tell you about Sellerdeck Services, what the benefits are, to provide periodic special offers and discounts and to explain how to subscribe to the Sellerdeck Services. We provide an opt out with each such communication we make to you.

We provide your email address and/or phone number and/or messaging address to help the platforms where we advertise (such as Facebook) find other people similar to you who may be interested in Sellerdeck Services. This means that more relevant advertisements can be shown to these people. They do not see your details and your details are not used for any other purpose.

For all of these direct marketing activities, we use Legitimate Interest as the legal basis and therefore you have the option to object and then be exempted from all of this processing.

If you have not installed our software agreeing to our license terms or utilised a Sellerdeck Service agreeing to our Service Agreement, we will only ever directly market to you on the basis of explicit Consent from you and you have the right to withdraw Consent at any time.

We occasionally source data from publicly available lists of trade companies to use only to target advertising as described above and again under Legitimate Interest. We never use this data to directly contact the companies.

Our Legitimate Interest is to provide marketing information to people running businesses who have expressed their interest in our products and services by registering their details and agreeing to our license agreement. We also have a Legitimate Interest in finding other, similar, people and our advertising suppliers similarly have a Legitimate Interest in displaying the most relevant ads.

You can request the complete deletion of your details from our systems if you have registered with us and never had a subscription. If you have had a subscription, we are legally obliged to keep details of our dealings with you but you can request that we do not contact you with any marketing.

Processors and sub-processors

Your data will be passed to the following categories of third parties so that we can provide the service that we promise; but in some cases, also to tell you more about our products and services:

Administering the service and processing information about how our system is running, finding and fixing problems plus developing new features

We consistently use the same subcontractors for specific individuals that form part of our team and these reside in Hungary, The Czech Republic and India. These individuals perform software development and support that occasionally and for a short time period may require access to personally identifiable information for fault finding or testing.

Providing support to our customers

Support, internal discussion and bug and task tracking: Atlassian Jira, Zendesk, other highly technical fault finding systems, monitoring and crash dump systems. All of these typically have low volumes of personal data and your data is only used when there is a problem or you raise a query.

Advertising

Facebook, Google, Twitter, LinkedIn, YouTube and similar companies where the limited data listed above is provided to enable people of similar interests to receive advertisements.

Taking payment from you

Billing, card and banking payment systems, currently: Sellerdeck charges you for card payments using Creditcall Ltd and direct debit using the Barclays Bank direct debit system.

Marketing to you

Web based marketing systems: Salesforce and Mailchimp

The third-party processors that we use are large responsible companies or organisations and we ensure that they have appropriate technical and organisational measures in place to protect your data. Many of these use sub-processors themselves such as cloud services like Amazon Web Services or Microsoft Azure to run their own services. In the case of payment processors, the entire banking infrastructure lies behind them and they pass data to Visa, Mastercard, other similar schemes, the relevant card issuer and acquirer.

Sellerdeck make their best endeavours to ensure that all third parties treat your personal data in a legal and appropriate way.

We endeavour not to transfer the data of EU citizens outside the EU but where we cannot avoid it we will only do so via a third party that have conformed to all of the appropriate EU legislation providing equivalent protection to that if the data was retained within the EU. In particular, we occasionally and for a strictly limited time pass data to our subcontractors who provide development and support where problems or developments require access to your data. This does not normally happen on a day to day basis.

How long do we hold your data?

Retention periods for data are dependent on the following:

  • The prevailing legal retention period where there is a statutory need for you or us to retain the data e.g. invoicing data and its related information. This is typically six years after the tax year end to which the data relates. We therefore hold such data for eight years and may retain it for longer if any enquiry or dispute relating to the data is under way.
  • We will completely delete your data on request where you have never agreed to our license terms or subscribed to any of our services.
  • We will delete your data from our hosting service after you cease to be a subscriber for this service.

Automated processing

We do not currently use personal data for any automated decision making within Sellerdeck or the Sellerdeck Services other than we send you different emails, notifications or other electronic communication tailored to you depending on which features in Sellerdeck you have used, tried to use or not used and also on your company size and type. Some advertisers, particularly Facebook and Google but there are others, are used by us and decide what advertisements to show to people based on automated processing of personal information, in order to make those advertisements as relevant as possible to the people who see them.

Your rights

You have a number of rights including receiving the information contained in this document (“the right to be informed”). Other rights are the right to opt out of any communication from us (other than where we have to contact you in relation to our Contract with you), the right to object to your personal information being used for marketing purposes under the legal basis of Legitimate Interest and the right to withdraw your Consent to being marketed to at any time if you have previously given your Consent.

You have the right to have your data totally deleted when you have not been a paying subscriber or agreed to our license terms. If you are or have been a paying subscriber or have agreed to our license terms, we process your personal data in order to provide our services and also need to retain data in order to meet statutory reporting including to tax authorities. Where that is true you do not have the right to have such data deleted, you do however have the right to have your processing restricted which means we will never use your data again apart from related to any statutory requirements.

You have the right to see the data held about you and to receive a copy. You have the right to have any errors corrected. You have the right to not have your data used in any way in marketing profiling or under any of the areas where we process your data under Legitimate Interest.

You have the right to ask and be told where your data came from.

You can exercise any of these rights by contacting our customer services team on admin@sellerdeck.com. Please start all requests with “GDPR Request” and then explain which right you wish to exercise. There will be no charge for reasonable requests.

You have the right to lodge a complaint with the information Commissioner’s Office (ico.org.uk) if you believe any of your rights are being infringed.

Acting as a processor for you

For data controllers, Sellerdeck will act as your processor in storing data on servers managed by us and passing data to our sub-processors on your behalf and acting on instructions received from you acting as the data controller. It is your responsibility as the controller to inform your customers, suppliers and employees of your processing and their rights, and to conform with the General Data Protection Regulations (GDPR) as this Privacy Notice. The personally identifiable information stored is restricted to the data that you have configured our software to capture.

The purpose of the processing is to enable you to run your business efficiently and provide an excellent ecommerce and telephone ordering service in relation to work that you do for your customers.

We will use sub-processors as explained above and you give your permission for this when entering into a Sellerdeck Services contract. Each sub-processor will agree to keep the data controller’s data confidential as do we, with the exception of where it is required to satisfy a lawful request from a legally authorised entity.

We will assist you in meeting your own GDPR responsibilities including fulfilling all valid requests coming from data subjects where we hold the data and submitting to audits and inspections including our processing records and co-operating with the ICO and informing you of breaches of the GDPR regulations. We will also explain on request our obligations and actions in relation to security measures and the notification of personal data breaches and provide help as required with data protection impact assessments.

We will delete data as required by you provided we do not have to hold it due to a legal obligation.

If you cease to be a subscriber to the Sellerdeck Services, after the Sellerdeck contract has been cancelled, other than as described in this document, we will delete your data.

Justin Taylor

I joined Sellerdeck in 2017 after 10 years as an E-commerce Manager running multi-channel online retail stores. It’s this experience which led me to join Sellerdeck. As the E-commerce Partnership Manager, my focus is on the success of our customers. I work with the teams at Sellerdeck to pull-together the best that we can offer, which has a strategic and positive impact on our customers.

Outside of work, I love to travel and have a large extended family dotted around the globe.

Josh Barling

I joined Sellerdeck in 2009, before the iPad even existed, and it was fascinating to be involved in an industry that was going through world changing events. Prior to Sellerdeck I completed an apprenticeship in Civil Engineering, where I was self-taught on AutoCAD to design structural drawings and 3d models.

After eight years in the company and towards the end of 2016, I wanted more perspective and exposure from other businesses, so I left to join a digital marketing agency who focused on technical SEO.

But I couldn’t stay away and in August of 2017 I was given the opportunity and privilege of being Sellerdeck’s CEO.

The company and its employees all share a set of strong values which is evident with every person you engage with. This is what I most admire of Sellerdeck and the people within the business.

Outside of work, my life revolves around the people I love and playing or watching as much football as I can.

Why Choose Sellerdeck?

In an online world filled with an abundance of E-commerce companies, marketing agencies and one-stop solutions, the big question is: Who do you choose?

Well, we here at Sellerdeck like to think that we can be the perfect fit for your company. Why? Because we’ve been doing it since 1996. Sellerdeck almost single handedly changed the face of E-Commerce in the UK with our easy to use Desktop E-Commerce Solution. Every business has to evolve and we’re no different. A name change, a re-branding and a lot of code later and here we are. Not only can we design, build, host and market your e-commerce business, we can work closely with you to become your e-commerce partner.

Just look at the growth of a site like Clubhouse Golf, breaking through a closed golf market to see how partnership has helped them.

Don’t wait, come have a chat with us. Even if you end up feeling that we’re not the provider for you, we’d love to hear from you, would love to chat to you and would love to get you started on the road to selling more online.

Claire Lupton

I have worked in Marketing and Communications for over 15 years and I could not imagine working in another job!

I’ve worked in lots of different industries and in recent years have specialised in digital marketing for technology and website companies. Alongside heading up the Ignite digital marketing team, I also manage the marketing for Sellerdeck. The best part of my job at Sellerdeck is working with the customers to help them create and achieve their marketing objectives. I work with a great team and all marketing projects start with a team brainstorm over a cup of tea, we allocate the different tasks, ranging from email marketing, social media, blogging, advertising and offline campaigns to the relevant person. I love the variety where every day is different.

My special object is Hugo (hedgehogs are my favorite animal), he was a gift a long time ago from my parents and he goes everywhere (within reason) with me.

Govindaraj Poosamani

Having worked in Web and Graphic design for 9 years, I am now a Senior User Interface Designer at Sellerdeck, working on both the design and development of Sellerdeck Cloud and Desktop Projects.

What I love about working at Sellerdeck is that I get to use my core skills as a developer and designer every day and for me great design is simple, pragmatic and efficient.

When I’m not working I love spending time with my family and chilling out.

Zsolt Rethy

When I graduated in 1999 I was already working as a developer for a German-Hungarian company developing automation software for warehouses.

I joined Sellerdeck in 2000 as a home-based developer, and in 2004 I completed a PhD in engineering. Since joining I have been in various roles but most of the time I have been doing C++ and Perl coding. My area of specialization is online payment systems.

Outside of work I enjoy spending time with my family.

Krithika Chandrasekaran

Having worked in customer service for several years, I joined Sellerdeck in 2004 as a Customer Service Executive. I’ve had varied roles at Sellerdeck and I’m now the QA Manager. The change in roles has given me the opportunity to learn and develop both professionally and personally.

What I enjoy most about working at Sellerdeck is being able to work with the talented, wonderful people throughout my 12 years. The comfort I feel in communicating and reaching out to anyone, that the geographical distance doesn’t seem to be an impediment most of the time!

I am a die hard foodie and an avid food blogger and reviewer, which combines my love of food, photography and social media! I’ve also just discovered a passion for making quilled and silk-thread jewellery.

Jawahar Jeyeraman

I started my career in Information Technology after completing my Engineering Degree in Computer Science in the year 2004 from Manonmaniam Sundaranar University.

I joined Sellerdeck in 2010 as a Senior Developer working on Sellerdeck Desktop. Today, as a Cloud Delivery Lead, I am responsible for various development, migration & deployment activities of cloud projects and resourcing. Sellerdeck has given me the opportunity to work with technology experts and gives me the space to grow and achieve my goals.

I enjoy spending time with my family, my daughter adds more joy to my life and I try to spend as much time as I can with her. I also enjoy programming, learning and trying new technologies and ideas. I love listening to music and reading biographies of the rich and famous.

Before joining Sellerdeck, I worked as an entomologist at the Natural History Museum in London, pursuing a long-held interest in wildlife. A few years in the voluntary sector followed, including 3 years managing communications for an international HIV/AIDS charity.

After joining Sellerdeck in 2000 I specialised in online marketing and search engine optimisation and then moved to product management in late 2008. I really enjoy the friendly team atmosphere at Sellerdeck.

Outside of work I enjoy being outdoors, taking photographs or watching TV with my feet up and spending time with my wife, 3 daughters and 5 grandchildren.

I’ve been at Sellerdeck for just over a year in the Technical Support team as an Analyst for the Desktop Applications team. I thoroughly enjoy my role as I enjoy dealing with customers, helping to resolve their issues and I work with a great team!

In my spare time I enjoy cycling and going on long walks. I also enjoy fly fishing, particularly for trout and salmon. My biggest Salmon so far has been a 25lb chinook salmon which I caught in Vancouver Island in Canada.

I’ve been working at Sellerdeck for the last two years in the Sales department. My role has developed from a Junior Sales Executive to dealing with clients on a more regular basis and helping them to grow their online presence.

The most interesting element of the job has been watching one of the fastest growing industries in history grow even further. My favorite thing about Sellerdeck is the collaboration between departments, helping to solve problems, deliver projects and improve the business. Everyone here is always willing to help each other out!

Outside of work I enjoy playing tennis, producing/playing music and consuming lasagne!

After getting a 1st Class Honours degree in Computer Science at ANU (Canberra) I worked for various companies in the UK. I started working with both hardware and software, but eventually turned to software and have been developing applications for Windows since version 2. I’ve been involved with Sellerdeck from the very early days; took a break for a while but returned in 2011.

I’ve been Chief Technical Officer since 2012. I enjoy taking the long view on projects, but also love coding. Making things faster is particularly satisfying.

I currently telework at Sellerdeck, so I get to walk in the Lake District at weekends as I live close by.
